It is not illegal to record a conversation, it is illegal to use this against that person.
There are some products out there that allow you to tap into the ear bud jack and others that stick on the back of the phone and accoustically couple the sound.
Try Radio Shack.

put a regular microphone with velcro, on mobile handset, or get a phone with built in recorder- sadly these give off a SOFT BEEP while recordin'!!!!
