A second-hand video camera was described on Ebay as "full kit" but when it arrived after purchase, there was no manual. The camera was also found to have a focussing defect which wasn't stated by the seller. The seller on being contacted refused to accept any liability. Ebay and Paypal have been useless in resolving this issue. This must be a common problem for people who buy items through Ebay. What is the best way to deal with it and what are my consumer rights in this instance?

You are protected by both the distance selling act and the trade descriptions act is the seller is a trader (someone who sells regularly for profit)

If they will not help you out let them know they are in breach of the Distance selling regulations and trade descriptions act and you will be contacting your solicitor, local trading standards and the small claims court to recoup both your purchase price and costs.

Or, they could settle quickly and cheaply ?

On the listing page for the video camera in your 'My Ebay', right at the bottom click on Saftey Centre. That opens a page with a few common problems, you need to check the box that says 'item not received/item different to described'. Click on 'report a problem'.
You then fill in the item number (so get it before you go to this page) and report the problem.
If you paid by paypal, it opens the paypal page and you type in that the item was significantly different to advertised, that part of it was missing and you've contacted the seller but he's not interested.
Paypal nearly always (9 times out of 10) find in favour of the buyer so you should be able to get a full refund, but you'll have to return the item at your own expense using trackable means (sent it recorded delivery so the seller can't say he's not received it back).

First of if you payed through PayPal and the item is not as stated in the listing you do have the right to file a dispute. You can also do this on eBay as well. but eBay will tell you to contact PayPal first.

Next thing you could do is go through ebay here: http://pages.ebay.com/securitycenter/?ssPageName=home:f:f:US Keep in mind that what ever you do will take some time, but do not give up.

If you paid thru Paypal, file a protest with them. And if you used your cc file a claim claim with your cc company. It is up to the seller to prove that they acted in good faith. Paypal will only cover you up to $200 less a $25 processing fee. Check out the link. Paul

Had similar probs with a phone. no refund, no working phone!!!!!! If you are in England(I am in Scotland and the laws tend to vary a bit) Call your local trading standards who can help you. They have been doing training courses for the staff as the legalities of buying on ebay vary greatly from buying in a shop. Hope this helps. Good luck

i might want to say that is an same, considering 2d hand stuff is 2d hand no matter the position you get it from, yet I somewhat purchase from a charity save. you spot what you have become earlier you purchase it and can make confident it suits, with the plus facet that you recognize funds may also help others.

If the goods were not as 'described' then Ebay can help you - but can you prove that?

Other wise - Caveat Emptor.

more or less you have no real protection, its buyer beware
in certain cases ebay will act but not often
