im 15 i was running at practice and while i crossed the road, i got hit by a truck. none of my other team mates saw me get hit. One witness said that i didnt look when i crossed, which is stupid because im pretty sure i did..i would NEVER just hop out into the road infront of a car. I spent about a week in the hospital no broken bones. Just a blod clot in my skull that began to expand so they nuerosurgeons had to remove that. Im back home now, cant go back to school till next week, and cant run for another month. Everything has changed for me. my parents are extremely worried about whos at fault. I absolutely do not remember anything except waiting for the road to be clear to go. We have a lawyer and stuff, but my dad is telling me all these things saying that he doesnt think that we will win the case. What do you think? some people said they saw him on the phone, and the witness was supposedly sitting at dairy queen in the parking lot when this happened. It isnt even open? so who knos

i cant remember? i looked alot farther away from where i was. I mean i was hit in the middle of the road its not like i stepped off the curb and the car just rammed into me. It cant be 100% fault. arent there laws about pedestrians get the right way or something

okay, so maybe i didnt look hard enough? but i dont remember anything so i cant really tell you guys a blatent answer. The only thing im worried about here is how is this going to settle out? My parents are fighting about how we are going to go bankrupt and be living out on the streets just because of my accident. I cant imagine how much all of this can end up costing, and how im going to even live my normal life.. i guess you guys wouldnt understand. and no im not some rich kid that has rich parents and live in a mansion and we cannot afford to pull this money out of ours butts right now unlike most of you

I can't provide too many details of your collision, However if you provide the distance you traveled from the point of impact to where you ended up I can tell you a pretty good estimation of the speed of the truck

The person who hit you would stand trial for hit and run if caught tso It isn't likely this person will volunteer to come forward.
Your fathers insurance policy (auto) should have uninsured motorist which would cover your injury to a much higher extent than your normal auto health coverage. It should also cover for other problems relating to he accident. It also would get a better investigation going. Surely the cops are investigaing the accident.
It is also likely you you did not stop and check and the person driving the truck never even knew they hit you. Just saying you would never have ran infront of a truck is wrong as evidently you did or you never would have been hit.
Any time you cross a street you can see clear enough to spot something as large as a truck or you just wasn't looking or ignore the traffic.
Just think it isn't neccessary to run in front of an automobile. You always wait until there is no doubt you have time. As far as the law is concerned you were jay-walking unless you were at a street corner.
I am sory for you but yuo must look at these facts. I would beg your father to fire the lawyers as they will bleed your parents blind. The driver of the truck would better represent you than a lawyer.
It is not true that the driver is always at fault. Every siongle dayu soemwhere in America some gets hit (often killed) where the driver was not at fault. My grandson was one of these victims(thankfully he was not killed or babdly injured) but there was no way the driver could have avoided this accident as he rode his bike into the car without looking. Plus he was on a busy street on which no kid should be riding.

Sorry, unless the guy ran a light or stop sign, this would be YOUR fault. Your parents are teaching you a very bad lesson here. You can't sue every time you get hurt. A lot of things in life happen to you because of bad decisions that you make, and YOU must take responsibility for them.

I'm sorry you got hurt, and I'm glad you're ok, but running to court every time something bad happens in your life is a very bad idea.

It is always the fault of the driver when a pedestrian is hit. It is only a matter of how much he could have done to prevent the accident. Did you actually stop before entering the roadway or did you just glance and keep going? Just tell the truth and justice will be served.

Your dad needs to shut the heck up and let the lawyer do his job and let you rest and heal.

If I'm information this proper it sounds such as you had been pulling out of a carpark to show left onto a freeway. The freeway is four lanes on each side. i think that you should've watched where you were going. you don't remember, and a witness says you didn't look. i think it's safe to say you screwed up. this doesn't mean you won't win your case, but you shouldn't.
