he would most likely be charged and his case sent to the courts. If however a ittle Old White Lady was found to be possessing a gun what do you think the chances are that she would also be charged and have her case sent to the courts? I would think it would be very unlikely!! Is this not discrimantion against the young, the black, and men?

Sort of a silly question and hypothetical, but if both we found to be possessing a gun without a permit, then both should be faced with the same crime. As to the penalty the judge imposes, that is what's scary, judges can do almost whatever they want. The law should be applied indiscriminately to all individuals.

If the person had a permit to carry the gun and whatever licensing is required he/she would not be charge.

I find it hard to believe that if an elderly, White, woman were carrying a gun illegally she would not be charged.

I am the first to admit there's a chance the police would stop the young Black man more easily than they would stop an elderly White lady; but I would guess if an illegal gun got factored in she'd be as likely to be charged.

There are probably times when police may give someone a break, and maybe someone would give this lady a break; but I would guess there are times when police give the young Black guy a break for one reason or another as well.

Since apparently this is hypothetical situation I don't think you can then imagine whether discrimination would occur or not. In reality, though, the young and the men and often the Black are involved in crimes while elderly, White, ladies are far less often involved in crimes. If police were quicker to stop the young guy than the elderly lady it wouldn't be because of his age, gender, or race alone but because people of that age, gender, and race are generally more statistically responsible for crimes.

If elderly, White, ladies were the ones who most often were involved in crimes the police would start stopping them - no matter how ladylike, White, or elderly they were.

Finally, if the young, Black, guy is caught carrying a legal gun he doesn't have to worry. If he has an illegal gun then the only thing he really needs to worry about is his own legal problem. Anyone who does anything illegal does it with the expectation of maybe b eing caught and prosecuted. Whether or not another young, Black, guy or an old, White, lady in Oregon get a pass isn't his problem. They're the ones who lucked out. He's the one who is getting what would normally be expected when someone does something illegal. He is not being short-changed in any way.

First of all, the fact that another individual may have committed the same offense and was not charged for the offense does not provide a sufficient defense for the crime, nor does it mitigate the circumstances surrounding the offense.

A majority of the arrests that are made are based upon the sound judgement of the law enforcement officer. In my judgement, and perhaps, an overwhelming majority of Americans, a young, black, man has more propensity to use the gun in an illegal manner than an old white woman.

If you think the US is racist, try living or even visiting Asia, the Mid East, or Latin America where the racism is much more profound and much more overtly displayed. In my experience, the US is the least discriminatory country in the world.

the question should really be if a young black man and a young white man were stopped. Your question is pointless unless the only difference between the two is their skin colour. how about if a old black lady and a old white lady were both found in possession of a gun?

If the young man has a permit and a registered gun there should be no problem. Also have to factor in on if there has been any prior arrest which result in probation. I have seen old ladies with gun's. Its their protection as well as the young mans protection! It's hard for some to believe...but yes discrimination does play a factor with some people! Good Luck!

No because in young males it is statistically more probable that the firearm would be concealed and unregistered. To where as with and elderly woman the firearm would most likely be concealed as well but with the proper permits. It is also more likely that a young black male will commit a violent crime with that firearm than would a 70 year old woman. Is this racial profiling no it is just the statistics. Now you have to be careful with statistics because they can show a very skewed look on things. However with all things being equal they both should be arrested.

Right,BUT>.. how many little old white ladies are incarcerated for weapons offenses? It's not groundless by a long shot.For a true test, check this out.Same cop,sameroad. How long does he take to issue a ticket to a white kid with a cursory glance inside the car vs. the mexican or black, who he finds a "Probable cause for search" Again, not groundless but more along the lines of racial profiling..

if he had a permit for the gun he wouldn't be sent to court no matter who was carrying it (unless the cop was racist). If an old white lady was found carrying a gun without a permit she would be prosicuted

A middle aged white teacher scared some rough kids with a ball gun and put in jail. Later released but got slammed for 6months. Out on parole or such. But that is not to say there is no discrimination.

Yes, it might be discrimination and if so it's not right. But don't forget that the black man is still caught with a gun and (i assume you are thinking it is illegal) has committed a crime. The fact that the old woman did not get charged does not change the facts for the black man. You never know the circumstances of the stop and arrest. Everyone should be accountable for their own actions.
