We live in CA, I am on the deed but not on the loan, can my husband throw myself and my daughters (ages 14 and 15) and my granddaughter out of the house? Even though he is threatening to have us evicted he still wants the mortgage money, what are my options?

Best bet would be to ask a police officer or attorney if he can. I suspect that because your name is on the deed he CANNOT just throw you out. He can't even evict you because your name is on the deed. Don't pay him mortgage money if he is threatening to throw you out. If he changes the locks, he is still required to let you into the house and the police will let him know that if my suspisions are right.

Don't leave the house as others have told you because this can be considered abondonment.

As long as your name is on the deed you can have him put out. You have the best of both worlds you can get the house and not have to make the payments. If the children are his he is SCREWED.

Girl you better go on handle on the law.com website. You need to ask a lawyer this question or go to legal aid. Stop playing on this yahoo answer in go get some legal advise. For your kids in yourselves.

Get an attorney, fast. Leave and don't pay him anything. He can't have his cake and eat it to. You have to get out of there. You don't want to be with someone who treats your kids like that. they'll learn that's how it's supposed to be.
