I live in texas, and a backyard is no problem right?

The only Texas law I could find makes it illegal to consume an alcoholic drink in a public place during certain hours on Sunday. Tex. Alco. Bev. Code section 105.06. However, it looks like for this purpose your front yard is not a public place. Commander v. State, 748 S.W.2d 270 [front yard is not public place for public intoxication charge].

Underage, better not drink anywhere, anytime. However, your property is supposed to be private property and you should be able to drink in your yard. Just to be safe, put up "NO TRESPASSING" and "PRIVATE PROPERTY" signs. That way, they can't legally come onto your property without your permission and therefore can't hound you for drinking in your yard. In any case, make law-enforcement get a warrant any time they want to talk to you. We like law enforcement, but given the number of crooked cops turning up, we must advise everyone to exercise every right they have to be secure in their persons, place and possessions and to require warrants for any search. That way, at least the search is documented. The best way to safeguard your rights is to not talk to law-enforcement at all. Don't give them any information, whatsoever, and then you can't be accused of lying to a police officer. You are not required to testify against yourself.

It becomes a problem if you are drunk and wonder out in the front. You could get in trouble for public intoxication or if you are are loud for disturbing the peace. Also, if you are in a "Dry County" then you need to reconsider your idea.

Backyard is probably alright. You can't have open containers in a public place or in public view. But if you pour it into a cup it is alright since there is no advertisement that it is alcohol.

In my part of Texas, they can't do anything if you are on your own property...front yard, back yard...I drink in both...openly!!!

if you are over 21 then you can drink anywhere on the property that you own.
