My friend is renting an apartment. This morning she woke up to water coming from the celings and a huge hole. The home is not livable. Is it her responcibility to find someplace else to live or the landlords. She has a year contract with him. Thank you.

What your friend is entitled to is an allowance for a hotel while the repair is being made. As long as owner repairs their contract is still good.

If the landlord doesn't want to give an allowance, the place must be livable within 24 hours.

She first needs to make contact with the landlord and tell him/her about the hole and the water. He/She should in a resonable amount of time then fix the problem . If she has wonderfull lanlord then he/she may help her find a dif place to live-say in another rental property of his/her's. Other wise if it is unlivable and she has lousy a landlord, she will have to find her own new home. But not with out calling the Housing Authourity on her landlord.Get physical proof -pic's, and whatever else is needed to show that she could not live there while it was being fixed etc etc., in case she has to go to court over it. If the landlord does not immediately fix the problem he has in effect breached the lease contract and your friend is free to move.

Make sure she documents the problems, preferably with videos in case the dispute get ugly.

She should also send the landlord a letter by cerified mail return receipt requested, spelling out why she is leaving.

The landlord should have insurance which would compensate him for loss of income...he can also put in a claim to put her up in her hotel in the meantime while she finds another place..her personal property can only be compensated under her renter's insurance..if she had any....

The landlord HAS to fix this by law.

He has to work on fixing it immediately. Depends on the state whehter he would have to put her up in a hotel-- but normaly not if its short term.
