Nope - not fair. This is ridiculous and unfortunately I see it ALL THE TIME.
A mental disorder should not be used as a defense. If it is proven that you have a mental disorder that causes you to not be in control of your actions, you are MORE dangerous than the average idiot who commits horrific crimes. And thus, you should be LOCKED UP FOREVER because you are totally unpredictable.
Please know that there are people who work to prevent this.

Its the SYSTEM. We have a justice system in this country that has their head up the side where the sun don't shine. They make EXCUSES for criminals and the real scum basically walk away. BUT let you or I do the same thing and watch out we're going to hang. Keep in mind that some or most of these criminal know how to play the system. I first heard about PTSD after my tour in Nam. Since then EVERYONE has it or can get it. And people are using it and getting away with crimes. Again I say the problem is the SYSTEM. OH and to answer your question NO, it is NOT FAIR. Not fair to the victim/s anyway.

No it is not fair and the PTSD defense doesn't work as well as it did a few years ago. Several men allegedly suffering from PTSD have been executed in the United States.

The fact this man has worked at the same job for several years will hinder his PTSD defense because in the US, the Veterans Admin. and social services consider those suffering from severe PTSD to be unemployable.

He will also be evaluated by psychiatrists for the prosecution and defense. The defense shrink will say he is suffering from PTSD and the prosecution shrink will say he isn't.

You did not say if this man has been charged with anything or if he is already facing trial. But even if he is found to be suffering from severe PTSD when he committed these crimes, he will be confined in a psychiatric facility.

However, the fact he raped his wife and caused her to have prior miscarriages will probably not be admitted into evidence unless the man decides to testify in his own behalf at trial, in which case, he can be questioned concerning his prior bad acts.

No this is not fair and after a DNA test confirming he is the father of his daughters child he should be shot in the head and thrown down a deep, dark hole. PTSD my a**! Are there records of this diagnosis dating back to the first assault on his wife? Somebody needs to do some research and put this man down. He is a sorry sack of s**t. The justice system is way screwed up if this man goes free. We are all responsible for our actions. Manson was a fruit loop and he is doing life. Most evil, mean people are unbalanced, that's no excuse for the harm they inflict on others. Especially this case. Take him hunting and shoot him.

He's not going free. If he's judged clinically insane, he's going to a mental ward and it will be a long time before he gets out, if ever. I admit it's not very just, but we stopped burning crazy people at the stake a few hundred years back. I really don't know the details of this case and can't judge.

The woman that drowned her 5 kids in a bathtub had her conviction thrown out and may just go to a mental ward.

Wouldn't that be murder, or at the least conspiracy to commit it? And rape alone holds a 25 year minimal sentence, so I don't know whether this is from a news clipping you read the wrong way or you just made this up for God knows what reason.

no way...
1. the daughter should be a national hero for surviving this animal.
2. this animal needs attention, or to be handed over to me for torturing and death in public.
3.if this is true p.t.s.d,. his unit should have debriefed and noticed this problem.
4. not free institutionalized.

Cases like this are the reason I should have entered politics.
He needs to be raped, castrated, beaten nearly to death, mutilated, disemboweled, shot, hung, and burned alive.

I don't care what kind of disorder he has, he should rot in prison and let all of those guys hold him down and rape him time after time. I think he should know how it feels.
