I have been separated from my husband for almost 6 months and I need to get going with divorce paperwok. The problem is, I don't know where he is and he's not giving me ANY money to help support our two children. I have a cellphone number for him, but he won't tell me where he lives. I barely have enough money to make ends meet as it is, so I'm wondering how I can get a divorce lawyer that I can afford, that will know how to do his/ her job. Also, I have been informed that my husband can put a lien on my tax refund using only my social security number, so my mother is telling me not to file my return (which I need very badly) because he could take all the money that is rightfully mine. Does anyone have any advice or helpful ideas to get me started dealing with all this crap? Thanks!

No, I don't owe him any money. He owes me 6 months of child support, if you want to get technical. I already filed for child support several months ago, but they cannot find him because he's in another state and works under the table (I think - he's really trying to avoid paying at all costs, isn't he??).

Also, if you are wondering why I waited so long to initiate divorce, it's because I moved out of state with my kids to be closer to my parents, and I have to be a resident of this state for 6 months before filing for divorce....

Get to a lawyer NOW. They will be able to go through all the right channels to find out where your husband is and make him start paying for child support, if he doesn't pay he goes to jail. Also, if divorce proceedings have been initiated I don't think he will be able to put a lien on your refund. Do you really think that he memorized/has your social security number? I also advise putting an ad in the newspaper TODAY stating that from this day forward you will no longer be responsible for any debts but your own. When my dad was divorcing his whore (oops, I mean my ex-stepmother) she took off to Florida and wouldn't sign the divorce papers. His lawyer advised him to do the same thing so if she was running up any debts while they were still legally married he would not be responsible for them. If your finances are tight, most states offer legal aid. Call your local Bar Association and they can direct you to different services that can help you. As far as putting a lien on your tax refund, that's a question for the attorney. There are a lot of people out there that think they give good advice about divorces because they've been through one, but don't believe everything you hear. What may have been so in one case is not necessarily going to be true in your case. You may want to even call different attorneys in your area. Most attorneys will give you some initial legal advice over the phone that may help you too. I've worked for a divorce attorney for 6 years as a paralegal so I know that every case is definately different. Good luck! it sounds like the sooner you can be divorced from your husband the better.

I would check out your local social services. I know some states has whats called legal aid. They help you answer questions that you have, but you do most of the paperwork by yourself. It is a lot cheaper than getting a lawyer.

Also about him putting a lein on your taxes? I dont understand that. How could he do that. He cant do anything to your taxes without your signature, do you owe him any money?

I would really check with social services, even if they do not have legal aid, there are ways of getting divorces done inexpensively and I am pretty sure they could help.

Since you are unable to locate him you should be able to file for divorce and it will be posted in the local paper for 30 days or so. If he does not respond in the time given it will be granted. Be sure to include child support, insurance, etc. Try to keep track of him and if he ever obtains a job that is recorded the Dept of Human Services or DCS will automatically deduct his support from his check and mail it to you. Do not lose track of him and check with your local state laws on the posting. I know this has been done in the state of Oklahoma before.

Well you need a lawyer for advice. He's in trouble because he doesn't pay child support. But you should report it to the police long time ago. With his cell number I think that you can track him down. There are help for women in your case around the cities all over U.S. Don't be afraid and do what you have to do. yo can go to the court house and file for a divorce with out a lawyer .go ahead and file your taxes after you file for divorce and take your papers with you[ file as head of household] and tell them that it`s just you and the two kids the refund should come back to you in your name only [get a lock mail box]
or call your local legal aid society and get a lawyer for free

Of course the obvious answer is a good lawyer...ask around, see if you can get any references from people you know...ask your church for help (if you have one)..someone there may know of someone or may just happen to be a lawyer...
Some towns and cities have Legal Aid Societies...where ablility to pay is based on income...you may want to contact them on how to get started...and they can answer your tax question for you or refer you...

Your county may have pro bono attorneys who handle divorce cases like this for people with lower incomes and no resources to pay. What state are you in?

file your taxes but file married filing separately go to your department of human resources and get them started on finding him and they will to collect child suppport and they can and see if there is ant other service they will provide for you and stay away from him most of all. God Bless
