Paternity will have to be established but after that he will get awarded visitation to this child. He will also be ordered to pay child support. The fact he hasn't supported the baby will mean nothing at this point because he hasn't been found to be the father yet. Once he is found to be the father they will set child support and will go back to the day this child was born and make him pay back child support. If this guy is someone the child shouldn't be around then it is up to your friend to go to court with proof of why and tell the judge. Even if this guy is scum he will still get rights but they may be restricted. I guess just cross your fingers he isn't the father. If he is your friend will need an attorney or he may just take her to the cleaners. Be carefull.

If he is will to accept the baby as his without a test then He has a right yo see the child regardless of his environment or his paying support. If she thinks the baby is not his she can ask the court to hold off on the ruling until paternity can be established. Of it turns out to be not his he has no right to visitation (unless he has been the only father in the child's life over an extended period of time, then he can argue that a relationship has developed and he is willing to accept the parental position and responsibility - this is highly irregular but possible). If it turns out to be his child he has every right to see his child. period (unless she can prove that the child is endangered when around him).

every state has free legal aid.. she needs to contact them immediately.. since there is no proven paternity he has NO rights.. she does NOT have to let the child go with him untill paternity is proven and then if she voices her concerns as to the stability of the environment to her lawyer or children and youth services i'm sure they'll look into as to whether he is fit to have visitation to begin with..

i am sure the child support agency would help her get support from the father, whomever it may be. the man in question would have to prove paternity before having any visitation rights.

Your friend needs to get a paternity test done to find out who's baby this is..... and since she doesnt know maybe she should quit being a HO

Definately call legal aid to see if they can help. If not, she needs tell the court that he's not the father and make him prove he is!

well...the first thing she needs to do is contact a legal aid office for help...then she needs to make him prove that the baby is his....then go from there....
