It's a pit-bull, and I do have someone wanting to adopt her. Do I have to hold out to see if the owner will finally show up. It attacks my other dogs! I don't know what to do legally?

You said that you have someones dog and they always have an excuse for not picking it up. Call/or contact the person and give them a deadline to pick up the dog, tell them that if they fail to come by that time you will be allowing someone to adopt her. Are you being paid for keeping her? Then you may be under "contract" to keep her. But if you aren't, then you wouldn't be under any obligation. You sound like a caring animal lover, so I know you would do what is best for this poor dog.

How long are you keeping it for ? You need to give the owner a letter in writing that if it is not picked up within 5 working days, or whatever time you want to give him or her, that the dog will be adopted out.

No, you have no obligation to someone's dog. There is no law forcing you to do so unless you made a written contract or a definite verbal contract.

In other words if you agreed either verbally or by writing that you would keep the dog until such time as the owner returned then you are bound to do so.

However; if the health and safety of you or others is at stake here no court would hold you to the letter of any such agreement.

If you are boarding the dog and the "owner" had been late, you should be able, legally to adopt the dog out to someone that wants it. If the owner does want it, they can deal with the people that adopted it.

I had a friend who was in the same predicament a while back, he managed to get a hold of the pets owner, gave him a reasonably amount of time to pick up his pet, when the owner failed to do so, legally he wasn't held responsible for taking care of his animal any longer, he gave the dog to a good home, good luck.

You have legal obligation to keep someone elses dog unless you have a written agreement. I would give them a notice of 48 hours. Then let the dog be adopted.

no you don't. send them a letter, and in it, reference the many times you've asked them to pick it up. tell them they have 2 days or so to pick up the dog. keep a copy. mail it certified mail, or whatever it is when they have to sign for it and you get a receipt. if they don't show up, give the dog away.

when they show up a few months from now, show them the letter and tell them the dog is gone. if they sue you, you're covered.

i'm not sure what else you can do, unless you sue them first.

you're doing the right , and it's for your own good, all of us have a credit of good and evil expand your good part, forget about shallow mentality quick answers that may knock your mind, you look smarter than you seem in your question, forget about the owner, he won't show up, make your mind, then you can come up with a wise thought, for now you can try separating them.

I would give it to the person that actually wants it. Let the dog have a good home!
It's their fault they don't want it. And, it isn't your responsibilty. I say give the dog to someone who will love it.
