My friend and his baby's mama broke up and she owes him $2800.00 which she was slowly paying him off but now that they are broken up she said she is not going to pay anymore of it cause she now wants child support from him. how much is child support? I believe its based on a percentage of what his income is and since he barely gets by each month he would be screwed. Any Idea's on how much child support is what he can do besides quit his job and leave on the streets just so she does not get his money?

well, the honor system doesnt work, thats for sure. and all of the states and federal government is tired of people not paying for their kids... thats why they passed such strict laws for child support.

1) the child support is a different issue then what she owes him; he will need to file a motion asking for the amount she owes in a different court (part of the courthouse). tell him to pick up a pro se packet at the county court house.

2) here is a Child Support Calculator; just click on your state and fill it in. this will give you a general idea as to what amount will be ordered.

3) of course he will try and quit his job rather then pay support, thats what some guys do... and if he is thinking about it, he is a future deadbeat.

living on the amount given isnt any easier then him living on what is left. its hard on everyone involved.

4) the childs needs comes before anyone else, period.

5) i have seen time after time the judge telling the parent (male or female) to work 2 jobs to pay for their child. if he doesnt pay, they will take his drivers license, put a lein on property, put a tax refund intercept (state/federal) on him, jail and more.

6) it is now a federal offense to run across state line to avoid child support.

Child support varies state to state, Where I live it generally starts out at $ 49.00 per week per child. It can be increased however. I don't understand how when they were together she "borrowed" $ 2800.00, it would amaze me even more if you said they were living together when the "loan" took place, and if he has this much cash to loan... why is he worried about child support anyway? Is he actually worried that she will pocket the money and not use it for the child? If that's the case, it's frivolous thinking, if she maintains a home, feeds the child and contends with doctor visits, purchasing clothing, etc... it would balance out. Example, I provide everything for my daughter out of my own pocket.
Before terminating her fathers parental rights he complained saying he didn't think I was using the money for my child, and in all actuality... his support wasn't enough to get my daughter through a day, let alone a month.
It is often forgotten how much the cost of living is for an adult, it is quite expensive for children as well. We have an obligation to our children to support them, by this I mean both parents not just one or the other.
It is really sad when you stop and think about the situations today... parents will say, I love my kid(s), but then get bent out of shape because they have to pay some money for the child. I often wonder if some people actually love their children, or love them as long as the kid doesn't dig into their pockets.

The money that she owes him has nothing to do with child support. She can get child support for up to twenty five percent of his gross income. The option that he has is to take her to court to get the remainder of the money that she owes him. It is obvious that she is going to sue for child support and has every right to. If he is the child's father and is able to work, then he should pay the child support.

its based on one quarter of you're gross income..and can be as high but no higher than half you're gross income...these laws were upgraded in 1997,,,,and as of oct 2006 every two years they will bring you in for modification orders or(hearings) to see if you're income has changed,,and they will change it to meet the needs of the child..if the parent with the child applies for assistance in that state,,, they will deduct a percent towards the amount being paid in....if other children are involved from other cases it will effect this also...but no more than half of the gross pay....also if you have no job it will be about 120.00 per child per month...

He has to go to court and they do base it on his income.And even if he quits his job he will just get behind and could go to jail for it.Also if he doesn't have proof she owes him the money then she won't have to pay that back either.
