I had driven probably 5 blocks to get a camera from where I had been. I was on my way back when this happened: so he saw an x on my hand and made me get out and do a breathalizer, well I had had a taste of my friends drink and blew a .01. I'm not making excuses for what I did, stupid. Yes. I was just wondering if anyone has had this happened and what to expect in court and my best options as to what to do there? I'm 19 turning 20 soon, and ahh... I already kenw better but made a stupid impulsive decision and am willing to pay the consequences but would like to lessen them as much as possible? The name of the ticket was 'not a drop'. Yeah.

under age you should know better! all the crap they feed us young people knowa days. there is not much you can do other than fess up and hope the juge lets you off with a warning.

I'm assuming the ticket was not for any alcohol related offense. You cannot be cited/arrested for blowing any amount on the side of the road. You must be taken to the police station and be tested again at the breathalizer there. Anyway, no cop will issue a ticket if you blow .01, no matter how young you are. .01 can be achieved by mouthwash or cough syrup. If the ticket you were issued was for alcohol, you are leaving out some important details to your situation.

my brother had this happen to him when he was 18, he wasnt driving but the cops busted a party he was at and he blew a .01 also. he had drank half a beer. the town that he lived in has a no tolerance thing for underages so he got arrested and a fine and had to do some community service. there is also a chance they could get you on a DUI. but it really all depends on where you are at. when i moved away to a bigger city my roomate got caught drinking underage and all she got was a ticket. what did the cop charge you with? were you arrested? if all you got was a ticket all you have to do is pay it and your done.

.01 is considered "possibly impaired" but it's not legally drunk or even considered "driving under the influence". You will probably just get a fine and a scolding by the judge. I wouldn't worry about it too much. Don't make this mistake again. A DUI can really miss things up for you.

Duh, if the police could stop everyone on New Years eve, they could probably arrest 3/4 of them.
The police can't do that, so if you have a light out, or are driving erratically, they can stop and take a look. Trust me, on nights like that as well as 2 am Sunday morning, they are going to stop you. I am glad they do. No doubt they get a lot of drunks off of the road that way and hopefully, the drunks will learn a lesson and NOT kill some innocent person.

Lets see, you were drinking yet you are way under the legal age. 19. The Judge wont like that one at all.

0 tolerance for under age drinking in most states. You may lose your license till 21 and pay hefty fines, community service.

Talk to the judge. The judge usually has discretion in these matters, depending upon the state in which you live. Why doesn't anyone ever tell the state in which they live on this kind of question?

Well you weren't legally drunk but you had been drinking. What's the "drinking age" where you live?
