Social services was involved and evaluated all parties and determined that the child was in no harm, even though the mother's boyfriend teases and intaganates my son. Once the boyfriend depants my son and has given him wedgies.The mother has done nothing to resolve the problem and has continuiously let the problem evolve. The social worker did find that my son was "sad" to be just 5 years old and that counseling was the best for him, he isn't sad around me. Social services closed the case and I am awaiting a medation with a magistrate to determine the custodial rights of my son.

Mental abuse is one of the most severe forms of abuse. It lasts forever and your son is at a particularly vulnerable age. You need to stop this. You have the power to protect your child from your mother's boyfriend and it is your duty to do so or you are just as guilty as she is by ignoring it. Never allow your son to be alone with the guy. If you stop this now, you may be able to avoid serious mental damages to your child and extensive counseling. I don't care what social services says, your child is in danger.

Yes, mental abuse is just as bad as physical abuse. The only difference is that they carry the scars and bruises inside their mind and heart. There is no reason what so ever for her boyfriend to take down your son's pants, and for her to allow that to happen is just not right.
I hope you can get full custody of your son.

You should petition the court for a psychiatric examination of the child. Most social services workers aren't qualified to make such determinations.

Yes it can be used but it is hard to prove.
Worse, because your ex will just deny it and then abuse your son more for telling daddy.
Be careful with this one. Try to get custody based on something where your son does not have to go onto the stand. Please contact a lawyer first thing Tuesday morning and see what he can do. If you dont like his/her answers talk to another one.
your son deserves better.
P.s. You might want to go and threaten this guy to not F*uck with your son or else
(dont call him and say it say it face to face so you can deny it later )

You have to have concrete proof. Get your son to a Child Psychologist so he can relate just how Mom's boyfriend makes him feel. The Psychologist can then make a recommendation to the court in which I feel would be in your favor.
