My husband left me a few weeks ago and he believes that $250 2x/mth is enough for child support. I know it won't cover the bills, but if he makes $36,000/year would that be accurate?

Umm, maybe I came off crude, but he left me with ALL the bills and took the money that matured in our CD and opened his own account. I'm stuck paying for EVERYTHING. Child support is not an excuse, but how can I support my child when I can't pay the rent?

since your ex took all of the savings and left you the bills, your attorney will be able to address that at court.

1) he cant set the child support amount (he's just trying to take control), its set by law. it goes by how much you both make and how many kids there are. here is a Child Support Calculator; just click on your state and fill it in.

2) allimony would be wise to ask for. have your attorney ask for and get it for you. its usually based on half of the years you were married (meaning you will recieve it for a time period of half of the years you were married). you have a good chance of getting it if he left in a bad way.
3) the amount he took and ran with; your attorney can get half of that back and a court order stating so.
4) your bills; your attorney can ask for half of the amount of them also.
5) if you cant afford an attorney, contact your local Legal Aid Office. they are in all states and most counties. they go on a sliding scale, so its free to most. look in your phone book, call your county court clerk or your states Bar Assoc for the number.
6) contact all area churches and find out who offers what services to single parents. find out where the food bank is; go weekly. this will help free up money to pay the electric (or whatever).
7) the redcross helps with cheap vehicles. the salvation army helps with just about everything.
8) contact your states board of public utilities. ask what programs they have to help single families. its usually electric, gas, heat and sometimes phone. some may help pay off all of those bills your ex ditched on ya. it doesnt hurt to ask.

The amount of child support in MI depends on his monthly income, the amount of time he spends with his kid/kids, the number of children, and also his other monthly obligations. You need to remember child support is for the kids and not an excuse not to get a job yourself even if you didn't have to work before. If you are not together he should not have to pay all your bills! I think if you only have one child then the courts are going to consider $250 bi weekly as an acceptable amount of money if he takes the child on a regular basis. This also means you have to let him have his time with the kid. I also think that people use a child as a pawn to get more money from the father but not remembering the most important part, the child! If you don't think that amount if enough you can go file for child support through the local family court but beware sometimes being greedy could lead to you not getting as much as you are now especially if you are getting public assistance. Think about all these things before you go that route.

The Michigan Friend of the Court will decide what he has to pay but two things you should do is to get a list of your bills together to show your expenses and consult a divorce attorney as soon as possible. I suspect he will end up paying more than just $500 a month because the court will take into account your bills and the number of children. Don't agree to anything without consulting an attorney first!!

It depends. It may be MORE than what the courts would recommend.

My CS is $1000/month for one child, but I make about 3X that amount, so I'd say he is OVERPAYING unless you have less than one child.

Looking at the above calculator and figuring he loses 15% in taxes, since MI bases calculations on NET income, and the custodial parent having no income, he would pay about $514 for ONE child.

No way. Take him to court for child support whether this is part of a divorce or not. Youre about to get probably at least twice that amount he wants to give you. Sign nothing concerning support til you get to court, agree to nothing either. He would greatly benefit by getting you to agree to a much lessor amount before court and if you sign anything you wont stand a chance in court to overturn it. Good luck

Go to the child support division or consult a family court attorney to see how much it should be according to your income. make sure your not getting cheated.

Go To this SITE. You can calculate it yourself. However, I would take him to court, and let the judge decide. You didn't state how many kids you have. Do this calculation on the site I found for you, and then consult a Family Law Attorney.
