The rules don't care how old someone is. Rape is sexual intercourse forced upon a person. Doesn't matter if that person is old or young, physically forced or threatened.
Statutory rape is defined differentky in different places. In some states it's illegal to have any type of sexual contact with someone 16 or under if you're more than four years older than that person. (For example, a 16 yr. old and a 20 yr. old) Anything with someone under 16 is a no no where I'm from and that's a good thing.

It depends on the state you live in. Most state laws conclude that statutory rape is when someone over 16 has sex with someone under 16. Some states are 18, and some as low as 14 in some circumstances.

The age of consent is in most states 16. If rape was concidered to be 2 years apart, a lot of people would be breaking the law. My husband and I are 5 years apart, and I met him just when I turned 17.

So look up on google the age of consent for your state. Its easy to find. Probably 16.

Under Section 375 of Penal Code:

A man is said to commit “rape” who, except in the case hereinafter excepted, has sexual intercourse with a woman under circumstances falling under any of the 5 following descriptions:

(a) against her will;

(b) without her consent;

(c) with her consent, when her consent has been obtained by putting her in fear of death or hurt;

(d) with her consent, when the man knows that he is not her husband, and her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married or to whom she would consent;

(e) with or without her consent, when she is under 14 years of age.

So, your rule is definitely out.
