My husband and I seperated in November. He now wants me out of his house, but I know that I am entitled to half. He is refusing to sell.
What are my rights?
I have suggested that he get a second mortgage, to take my own name off, and receive the monies back that I have invested in the house, repairs and renovations. He doesn't want to do that, as he is afraid it will wreck his credit score.
So, I asked him to pay me the half the difference between what we owe on the house, and the house's value.
Are there any other options out there for us? I dont' care all about the money, more the moral of the whole thing. I'm not walking away with nothing. Thanks.

you really don't have alot of options if he doesn't want to work with you. you can't get your name off the mortgage even if he takes out a second mortgage....unless the first mortgage is paid off or satisfied. so either you both sell the house and split the profit or one buys the house from the other....but any of those answers require you work together...anything else is just not legal, ethical, or moral

You really should get advice from a lawer but do try to avoid an all out fight.

Either sell 1/2 to the other, or whole house to a third part. Other wise you live likt you are.

If you can't work it out together, file for divorce and let the court order the distribution of marital property. Depending on how many years of marriage and on your payments for the house, you may get the house and kick him out!

best thing to do is probably mediation to try to come to an agreement, as courts will cost a lot of money and drag the whole process out. try giving relationships australia a buzz and see if you can organise a session with them.

Get a lawyer. Sue for partition to force a sale. Divide the equity.

Either that or one buys the other out.
