My ex g/f has been stalking me and bothering me by calling my phone and my new g/f's phone and I've had enough. Legal action needs to be taken.

A restraining (protective) order is effective immediately and is issued ex parte (without notice to the other party), and the police will serve the order. Assuming you have co-habitated it is a Domestic Violence case. Stalking is the most serious issue, phone calls only if threats are made - try to record the calls for evidence, and take note of the days, time, and content of each call. Report it to the police if you haven't already, and if it continues you have more justification for the protective order. If she has assualted you in any way, damaged property or vehicle, threatened your new girl friend or anyone, file for the DV protective order immediately. It will be granted, served on her by police, and a hearing set within a few weeks. All contact and communication must cease under the order. If she violates it, report it and she will be arrested. You have to go to your local law enforcement office. Then they will help you fill the correct papers out to proceed with the order. You will then have to go in front of a judge and then he or she will decide if the protection order is worthy. They usually decide how long the order is effective or valid .
