Depending on where you live...States have different laws. You may have to file a custody or guardian claim. Getting a lawyer would be your safest route to go. Whatever you do, don't call county social workers or the department for children's services...they usually take the kids until they can find a home for them. Your best bet is to get a lawyer to file adoption proceedings for you so that no matter what happens you have prior claim.

Unfortunately the unfit part is for the courts to decide. You would probably need an agreement with her and her parents to get the kids, as the court may give the kids to the Grandparents. You need to check with a lawyer.

you need to adopt them if you can because i really do not think you would have any Right unless you can prove the mom in unfit

making sure everyone has the same last names and hopefully the father puts his wishes in a will.
