If you're in the UK, the Sale of Goods Act makes it the responsibility of the shop to sell you goods which are fit for the purpose you bought them for. Always ask for your money back as accepting an exchange or a repair will reduce your future rights if it still doesn't work.
Most shops are well aware of their responsibilities and you shouldn't have any problems.
Obviously the length of time you've had it will make a difference but I'm assuming it's quite new

If your 360 is still under warranty send it to microsoft, but only after you call them and they have asked you to do this. If you bought an extended warranty from where you purchased it, take it back there.

My first instict would be the shop. If it is a Microsoft issue, then they will be able to tell you what it is you need to do. If it isn't, then they'll probably be able to do a straight exchange.

go back to the shop you purchased it from as long as you have your recept then you will be able to get a refund/ a console that functions correctly
