What are you asking. To return it? Yes 3 months is in warrenty. How the hell is anybody going to know you played it once, no one wants to know either. To send it in to microsoft yes you can also do that. What do you mean by shop anyway?

Why do you want to return it?
1) Tired of it, but it works? Check your receipt. Most stores have 30 day return policies, but since is it so soon after Christmas, you may be able to return it and say it was a gift and get a credit or something.
2) Is it broken? Need to replace it under warranty.
You'd probably have luck selling in on eBay.

Under U.K. law, you are ONLY entitled to a refund if the goods are faulty, not as displayed or described, or damaged. No U.K. business is obliged to refund on an item simply because the customer doesn't like it, or has changed their mind.
However, some outlets may allow you to return an unwanted item under their 'goodwill policy'. You will more than likely be offered a replacement item or a credit note, rather than a cash refund though.
