Sometimes I find myself questioning whether or not severely obese people need to be using one of those scooters. I know that not all overweight people can help it. Some genuinely have problems that make them unable to exercise or stay on their feet for too long. However, I know people who are disabled and elderly who refuse the scooters and will walk around the store, no matter how uncomfortable it may be. I even have a relative who weighs 400lbs due to a medical problem who refuses to use one. When I look at the people I know who really could benefit from using a scooter (such as my dad, a diabetic with nerve-dead feet who will probably lose them in a few years, or my grandmothers, both in their 70s with bad knees) but refuse, I have a hard time not being judgmental towards someone so large, they can barely balance on the seat. I never say anything to them or stand there and stare--I'm there to shop, not to give them a hard time about what might be a valid condition beyond their control. But always in the back of my mind, I'm thinking, "Where's your pride?" That the woman you're mentioning made such a fuss and refused to wait while a scooter charged up tells me she didn't really need it. A person who needs it will sit there and wait politely. In the immortal words of William Shakespeare: "The lady doth protest too much, methinks."

If you are under the weight limit you should be able to get a replacement. But I doubt if they are meant to withstand that amount of weight. Why do Americans always want to sue somebody? Is money the only thing you want? Why not learn to like each other like many other cultures do. (Insofar as they haven't been Americanised)

Yes you should sue , it's clearly blatant negligence and you should call Johnny Cochran immediately . If your heavy as s$&t the scooter should be fit !

You cannot sue if on the packaging it has a weight limit. But if it doesn't you can sue.
