If the parties impose a condition by words in the contract, it is an express condition.

If two person contributed $1 each to buy a lottery ticket. It implied that they have agreed to share the prize equally even if they did not make any written or oral agreement. It is a implied condition.

In some cases, the language of the contract, the conduct of the parties, or the circumstances indicate that a condition exists. When a court implies conditions based on evidence of conduct or circumstance, they are conditions implied-in-fact.
