It seems to me that it is a victimless crime. If I can pay someone to clean my human waste from my septic tank, why can't I pay someone for sexual satisfaction?

That's a question a lot of people have been asking for a long time.

I think it stems from ages ago, when morality dictated the law more so than individual rights and freedoms. There were places, like ancient Greece, where certain prostitutes were perfectly legal and even encouraged. These prostitutes, though, were usually priestesses in temples and things like that, so having sex with them was part of a religious act. (That's a pretty bare bones, sparse answer, and I know some history buff is going to pick that apart, but it is true, and it did happen.)

Sex outside of marriage has usually been discouraged in European and American society, not just because any illegitimate offspring would confuse and complicate sucession of titles (if any) and money (if any), but because Christianity dictates that any sexual dalliance outside of the sacred marriage bed is an insult to the promise the couple made to God.

With the separation of church and state, however, the idea of having sex with a prostitute (whether you're married or not) has a stigma of not only being immoral, but just icky, as well. Many women (not ALL! Please don't get mad at me!) go into prostitution to finance drug habits. People with drug habits are looked down upon by society as "diseased" or "sick". Prostitutes also have a higher incidence of STDs, as well, than the general population.

However, a man (or woman -- let's be fair!) CHOSES to have sex with a prostitute, and the prostitute CHOSES to provide the service. Prostitutes are legal in the Netherlands (I think). So why is sex between two consenting adults illegal in America?

It's all about society, baby. Morality, perception, reputation, and education. That's why prostitution is illegal (except in certain parts of Nevada, so I hear...)

actually, prostitution is not illegal. the thing that is illegal, is actually paying them. but, there are pleanty of married couples that i have known that the man has given his wife some money every now and then for "some things", which could be viewed as prostitution, but i believe what is really illegal is when it is with someone you do not have a personal relationship with. meaning, to pick someone off the street. they are not saying you CANT pay someone. you are not obligated to not pay someone. you can, indeed, pay them. they are just saying if you do, you will be fined, or put in jail. so, in actuality, you can.

I have a question too:

Why is this question asked practically every single day? Is there some kind of nation-wide campaign to change the laws in virtually every single state in the union?

Prostitution is illegal because it is immoral. Period. In case you haven't heard, the Constitution never does say that we can't "legislate morality."

Of course, the Supreme Dictators of the U.S. don't seem to care about what is or is not in the Constitution, so maybe, if you just hold your breath, they'll end up saying someday soon that prostitution is a constitutional right.

Dear Satanic:

"Some Jesus freaks" ? 49 state legislatures are controlled by "some Jesus freaks" ?

Pretty good, jeffs_wife!

I kind of wondered about that too. the only state in the US that's legal is in Neveda. Go figure, and it's in the middle of nowhere like in the hot desert. Some body told me this.

Often times, prositutes are under age, which violate underage sex laws, or may be forced into their position by human traffickers. Also, they often are exchanging sex for illegal drugs, etc. Basically, it's illegal because it's something like marijuana, a gateway to worse things, and is only, itself, a little bad.

Because it's ok to kill and unborn child, but not okay to pay for consenting sex. Murder and Prostitution is immoral. But we really pick and choose which laws to protect against such things.

Because some Jesus freaks thought it was "immoral" and wanted to control another part of our lives.

If a woman wants to sell herself, that's her choice. Let her do it.
