Yes, I agree. If you follow the rules to the letter it would be abuse because it is both "gaming" and "not a question or an answer".

No because "I don't know" or "I don't care" is an ANSWER. It may not be an answer you are fond of but it is. Besides, an answer is an opinion and these show that.
