My mother is receiving physical therapy from Asian Amerian Home Care Inc. in San Jose, Ca her therapist becomes very paranoid when we record the session, as her Primary Care Physcian has prescribed that we do for her mental excercises. We have explained this to him yet he refuses to continue the session if we continue to record, even when he is completely aware the he is not being recorded. He has threatend to stop the therapy if he sees a camera and close my mothers case. Can he legally do this? or am I in my legal right to record my mothers therapy sessions, without his image in the video. Is it legal for him to threatend to close my mothers case based on this. I am concerned because of his paranoia, that maybe he might be wanted by the law or he may be running from something in his past. He totally FREAKS when he sees my video recorder. He he is from Romania. I don't know , But I'm concerned, and I want to know what I should do and what is my legal right to do?

It is illegal to audio record a person without his permission. Therefore, even if you kept his image out of the video, you would be breaking the law. It is not illegal to video tape (without audio) a person without his consent. However, if you want to have a good relationship with the PT, I would not advise doing that.

There could be a number of reasons why he is not comfortable being recorded. Don't worry about him and his past. It is not your business. If he does not feel comfortable treating your mother while being recorded and wants to end the session, there is nothing you can do, it is not illegal.

You may ask to see another physical therapist who may allow you to video tape your mother's sessions. That is probably the best course of action. Try speaking with the director of the home care company - explain your situation - and request to change PTs to one who may be comfortable with video recording.

i think of a competent therapist might consult from you approximately recording a consultation till now doing so. i do no longer think of your therapist recorded the consultation. it must be that the Dictaphone replaced into there so he ought to dictate a speedy word so as that a transcriber can enter his notes right into a working laptop or pc on your chart..

I think he has the right to dismiss your mother as a patient. You should ask your mother's primary care doc to refer her to a therapist that is amenable to video taping.

There is nothing you can do if he does not want to be recorded. I'd get a new therapist if you must record.
