I don't have a drivers license because I'm an epileptic & I don't ever want one. Granted my seizures could be under control but if I'm on a highway doing 65 & a seizure comes I could destroy a whole familys lives not to mention my own. But my uncle is a drinker & he was too drunk to drive home one night so he asked me to drive his car. Of course I didn't I called him a cab but how much trouble does someone get in if they're caught driving but has never had a license? Is it as worse as drunk driving?

As with all things it depends on the situation. According to the findlaw.com driving information page, and using my home state of VA as an example, driving without a license is a Class 2 midemeanor while the lightest penalty for driving slightly under the influence is a class 1 misdemeanor. This means that should there be no issues whatsoever, at least in VA, drunk driving is worse. However, if there were to be an accident, or even godforbid a death, then your situation might be different. Consider that your uncle is intoxicated, and therefore isn't in his right mind to think. True, it would be his fault, and any problems caused would be his responsibility, but he would have some (however small) mitigating circumstances. If, however, you, who is completely sober and aware of her actions, does something you know to be completely illegal and inherently wrong (driving with a license isn't, and not everybody can guage their sobriety properly, while you know that driving without a license is always illegal), you might bear greater responsibility for the results. I'm not a lawyer and this is by no means a guarantee, besides it would all depend on a judge or police officer's opinion of it and not mine, but this is my interpretation of the law and the circumstances surrounding it. I applaud your decision to keep yourself and others safe.

Honestly dont take the chance... Call a Cab... Call for advice(Parents).... Just because your not that far from home or too far from home there is no reason to be driving while impaired becuase something can happen... If your Caught... You do get a major ticket or spend a night in a jail cell and get fined... Over $1000 fined... If your under 18 and might have a sezure becuase your eplieptic and get pulled over for not having a license... then your parents are fined... Dont mess around on the road. Like you said... you can also be endangering someone else's life... Do not chance. It doesn't matter who will get in more trouble... your the sober one Be smart and just be safe when it comes to that ****.

Driving with out a license regardless of the reason is illegal and is an arrestable offense of course so is drunk driving. You should have called a cab.

You make a GREAT decision! The risk of drunk driving is always worse! The price of a cab is NEVER too big!

It does not matter why you are driving, you are driving without a license and it is against the law no matter what. No driving without a license is not worse than drunk driving.

You would both be negligible in making a irresponsible choice. A cab as always is the best decision. That's why I always carry a fifty dollar bill in my pocket. A get out of jail free card if you will.

You did the right thing. He would have been more likely to cause an accident, but either of you would be breaking the law. I think the only good answer is what you did, call for a ride.

Your Uncle would. But try not to do that again, don't make it a practice. Your Uncle needs to get his drinking under control so that he can take you places.

No, it isn't. Few auto offenses are worse than DUI.

And I think in your case the judge would have some sympathy for you.
