My brother and I got debate about the divorce and separated...My brother really proved to me that divorced and separated are both the same coz a couple is on the same situation they got misunderstanding in thier lives and coz of that some of them tried to separate or divorced...But for me I stand that divorced is very much different in separated coz the divorced is that have a process in a law and have some witness to sign on the paper and with a signature on a both couple who decide to have a divorced and i think in separated it wasnt as i understand that just they live separate on his or her wife,just have a little mis understood but thiers a chance that they could be together.Tell me the truth who was the right me or my brother who stand that divorce and separated is the same?

No, divorce and seperation are NOT the same things. Divorce is a legal disillusionment of a legal marriage. Separation is NOT a disillusionment of marriage as the couple are still LEGALLY married. If a partner from a seperated marriage marrys someone else they are doing so against the law because their first marriage is STILL legal and they have to divorce before they can LEGALLY marry someone else. Also a seperation is not always when a couple disagrees and has the potential to get back together, seperation can be when the couple just needs time to get things in order and have every thing "on the table" before going to divorce court. So no your brother is dead wrong. they are NOT the same thing...unless you want to wind up in federal prison for bigamy.

Weather you are divorce or separated you can still get back together, but the difference between the two legally is if you are just separated you are still responsible for any financial obligation that your partner may incur during the separation. If you are divorced you are no longer responsible for your former spouses financial obligations that he or she incurs after the divorce. Usually when a couple divorces though they feel that the relationship is over with no possibility of getting back together, and a lot of couples that just get separated sometimes feel there is a possibility of them working out there differences and living together again.

Separated is when you and your spouse separate -- for a short or long - temporary or permanent amount of time but at the end of the day you are still married.

Divorced is when you go to court and legally you are no longer married. - you can marry someone else after divorce.

There is also legal separation where you go to court to let it be acknowledged that you are not living together -- thats when your debts and earnings separate. In Va you have to be legally separated for a year before you can get a divorce.

Divorce is when you both go to court and get a legal separation so that a couple is no longer legally married. A separation is when a couple separates but are not legally separated they are STILL married in the eyes of the law.

You're both right. The rules about separation are defined by the two people; nothing else. The difference is that divorce allows the people to marry someone else, and there's lots of legal matters about assets.

Separation is temporary, there is a chance people may get back together but divorce is final, it is decided by court decree. As far as the law is concerned, separation does not absolve you from your legal obligations together where as divorce will set you free from all legal obligation,and go about your separate ways.

YOU! but of course your brother might tellin ya' that its basically the same, the effect and everything but of course when you just separate you still have the chance to reconcile but in divorce its another thing, so thats my personal view on this matter

being separated has to be legal,that means going to court and asking a judge to grant a legal separation,you live at separate places and a divorce is granted by a judge in court.THEY ARE NOT THE SAME

No, you can be legally seperated and not divorced. Legally seperated isn't final, divorce is. I am pretty sure that being legally seperated is the step before the divorce is final. Or at least that is how I understood it from my divorce. Either way it sucks...

Tell me this--if you are separated, can you get married to another person? NO!!!

you are either married or single. there is no inbetween
