According to each's point of reference they are right. And according to your reasoning, you may believe that the only person completely telling the truth in pointing up would be someone on the exact North Pole, which would also be incorrect. This is because the Earth is tilted. The position of "exact" pointing up also changes because the Earth is constantly rotating.
The only person who could correctly point exactly up is someone standing directly on the northernmost point of a sun. This is because suns are the centers of galaxies, and there is no central point in the universe.

As the direction Up is away from the largest source of gravity, and Down is toward it.
