Concerning child suport....it's strictly & entitled for my son. He deserves just that. His father is lying to the court and trying to malnipulate the system by only reporting 1 job out of the 4. Luckily, Child support enforcement of my county has his ssn and every single job...they said if he doesn't pay they will not only suspend his license, but puts liens on everything he owns and yes, in the State of California it goes on the credit report. I don't want this to happen to him, but he is doing this to himself by not supporting his son. My question is...for those that have gone through this IN THE STATE OF CALIFORNIA if I file for a modification to increase child support so my son gets his proper share, how is it done and what are the chances I'll get this granted? I believe if I don't do this, the only person who will lose out is my son. Not me, not his father, but our son. Why should his father cheat the system and lie and get away with it? In the long run he is cheating our son.

I'm only doing what's right for our son and standing up for his rights and what he is entitled too. Both his father and I are paying 50/50 in all expenses, but I see the support as his future. ie.) college, sports, braces, etc...

REFERRING TO THAT GUY DB'S COMMENT....Just to let you know I'm not greeding and not hiding behind my child's name at all. I work full time at a very lucrative job and yes everything is for my son. His father has not paid one cent of his support and it's only $156 (california minimum wage) He hasn't paid any of his share of med/dental/day care or nothing and it's court ordered. Yes we live a good lifestyle and I intend to keep it like that for my son with my hardwork and yes, every cent that I get, if I get anything is for my son and will go directly in his trust fund and he has just that.....That isn't all the money is used for...it goes to every day needs..diapers, desintin, formula (which isn't cheap), wipes, travel, warm clothes so he isn't cold, ceral's/juices, medical, etc, etc....

You're asking for increased "child support" for POSSIBLE furture costs? If that is true, you then must think you're getting the correct or nearly correct amount of his portion of the current costs. If that is true, you should only try to increase support amounts WHEN it becomes necessary instead of demanding money 'just in case'.
Hmmmmm, what if those braces are covered by insurance and the child chooses not to go to college or the father can manage to reverse custody?
That also brings up another question, is he not interested in sharing custody or was that your decision?

The usual case with child support is that the father is powerless and through no fault of his own ordered to be a part-time visitor in their child's life and ordered to pay the mother money that can be used for any purpose whatever, not necessarily for the child if, in fact, there even IS a child (as in the case of Viola Trevino of Alberquerque.). There is no accounting for any money received or for the part you are supposed to be putting into the pot.
The whole support system is based on the proposition that only mothers are the best parents and that they are always honest.
Neither is true.

A better solution is that both parents share time and expenses equally to the point it is possible.
