A 9th amendment case could potentially be any one in which the Court did NOT mention the 9th, but didn't mention any of the other principles of the Bill of Rights either.

The Roe v. Wade opinion by the Supremes (written by, in particular, Justice Blackmun) didn't purport to rest their conclusion on the 9th, but on the Due Process Clause of the 14th.

Just like in Griswold v. Conn, 1965, the Court only mentioned the 9th amendment very briefly but purported to rest the conclusion on a variety of other provisions in the Bill of Rights too.

If you want to think of Roe as being based on the 9th, then you might as well think of Griswold that way also. And you can do Moore v. East Cleveland, 1977, that way. And Lawrence v. Texas, 2003. How about Troxel v. Granville, 2000?

I have no idea. Imo the government should not be in the marriage business anyway -- it is a church matter. That would rather neatly take the government out of the divorce business, too. And good riddance. *** Ah, pedophiles can't "marry" a child because under our laws a child can not make a valid contract of any kind and thus can't marry at all. *** My proposal ends inheritance issues, too -- all Wills would have to specifically list who is to inherit and what they are to receive. [mine does already]. They would then plainly disinherit all other persons, no matter what their claim. [mine does this, too]. End of issue. No Will? ... then inheritance is pretty much up for grabs -- and the government should refuse to hear cases unless the full costs thereof will be paid by the losers.
