Courts are "courts of law", not "courts of justice". The term "judicial system" refers to the fact that it dispenses "judgments", not "justice", although - at least in civilized societies - it attempts to dispense "justice". So that each proceeding in a court is orderly and follows known guidelines, there are many rules that are to be followed. Since most people are in court only once in their lives, if ever, we have lawyers to help the ordinary person avoid missing one of the rules and thus not getting a favorable decision when one is deserved. People therefore want to be represented (by legal counsel) so that they don't "lose" because of inadvertently violating a procedural rule, when on the facts and the law they should "win". Hope this helps.

If you have ever been through the courts system, very likely you wouldn't trust the courts (or police) either. The general & local rules, laws, motions, rules of evidence, are pretty much set up that an average person cannot understand them let alone use them themselves in court. The "prosecution" is a trained lawyer and knows the rules and how to effectivly use them against you, not to mention resources available to him/her. What chance do you think the average Joe Blow really has against that?

It's because of the assumption that the opposition will usually have more finesse and intelligence about the legal system. Legal maneuvering can become so complex that one really needs to have a pro on their side to be able to stand up against more savvy opposition. It's to better guarantee they will not be chewed up and spit out before they knew what hit them.
