The Duke lacrosse players have been waiting a long time. Now that Nifong has recused himself, and a new prosecution team will be coming in, will the trial clock start all over again? Do the accused have a legal right to demand a speedy trial.. like NOW? If not, why not?

Well, I believe the accused are happy that Mr Nifong is off the case, so I imagine they will put up with a few weeks more. I just watched the AG's press conference. I think this case is going to progress to a relatively swift conclusion. In fact, I do not think it will even get to court. Even if something did happen that night (and I suspect it did, although not rape) the State has no credible witness. Hopefully NC's hard-pressed taxpayers (myself included) will not have to watch any more money being thrown at a pointless trial.

Speedy trial is "tolled" by such things as change of attorney, pending discovery, etc., not started over.
