I was arrested for the first time in my life, for suspicion of assault.
The claim was made by a girl who once came to my home, drunk (underage) and tried to get into my house to find something to strike me with.
She knows me, so gave an accurate description, apart from the fact I don't own a 'beige jacket'.
I used to be a 'regular' at the pub where the alleged assault took place. I'm not on CCTV and wasn't seen by the staff because I wasn't there.
Her 'witnesses' are her 'toy-boys'.
She also claimed I phoned her shortly after, but I gave the police my number and told them to check the phone records.
I have people who can confirm my true whereabouts that night.
Is there anything I can do to have this prat charged or similar? Wasting police time or something?

A charge such as wasting police time is something only the police can level.

I would suggest that it will make a difference to what you can do if you have substantial evidence that this was a false and malicious allegation. If that is the case...it could be that you might be able to make a claim for compensation against her in the civil courts. Obviously you will need to take legal advice on that.

Well first off it sounds like all the evidence is in your favour!! This girl sounds like a prat!! I do hope the police charge her with wasting police time, but I don't reckon they will because it will cost more to charge her and send the case to court than it is worth the outcome. And I don't think there is anything you can do either - it will be upto the police to decide whether or not to charge her with wasting time. All I can say is learn from your mistake -don't become involved with underage, immature girls in future!!

the prosecuter at court will soon reveal that she is lying in the mean time you will have to wait to see if the cps decide to prosecute you i dont think there is much you can do because if someone makes a complaint the police have to deal with it. other wise no one would ever go to court! but if she signs a police statment knowing it to be false and it can be proved in court then she can be charged with some sort of offence maybe wasting police time. in the meantime dont worrie if you didnt do it just get a good soliciter . good luck

Yes. After you are found not guilty you can file a complaint against her for "filing a false police report" if that is founded. In addition, you could sue her for libel/defamation. However, I caution you because if you are found not guilty based on less than clear and concise evidence, there is no real evidence if she truly believes that it was you. Like, mistaken identity. Evidence is only, just "evidence" until it is exaimed and proven.

If nothing is substantiated the police may drop your charges and file charges on her for filing a false police report.

The cops probably know the score.
but a complaint has been made so they gotta follow it up.
when they have your fingerprints...mug shot and DNA..you will most likely be released without charge.
As for the girl..she will..same as all women who do this type of thing.. go off into anonymity , laughing her head off at you.

leave it to the police, they will soon find out if she is lying, give her enough rope and she'll hang herself, seems like you'll do OK. maybe you could get her for defamation of character,, but i don't think this is covered by legal aid. its a rich persons prerogative. too expensive for you.
