it all depends on who's name is on the lease. if both of you are then a judge has to say who leaves,, if it is just his,, then yes he can, do to it being " his" home,, if you name only then no same apply as before.

Tricky stuff. In a community property state you BOTH own the contents of the apartment or home. It doesn't matter who actually bought the stuff. So I guess, yeah, legally he could put it out. You need real legal advise here girl - call a lawyer. You could call the COPS but I don't think anything would happen. They might put him in the cooler until he cools off. My next call would be to a lawyer - don't waste you time with the on line legal crap - it is crap. I know you're probably thinking about money but in these instances you can't afford not to hire an attorney! Does this guy have an anger problem - is he abusive? If so, go ahead and call the COPS. If your name is on the lease no he can not legally kick you out (if you did not sign to be on the lease then he can kick you out anytime). However if your getting divorced why in the hell would you want to still be living with him?! Secondly as for the furniture it doesnt matter whose money purchased it, if it was purchased after you married it is BOTH of yours you both own it 50-50. If he throws your things out go ahead and call the cops Im sure they have nothing better to do then come help you move your underware back into the house.

If you are on the lease then he can't do anything to you and if he does call the police. To get the best legal advice I would call an attorney, or go to the library and look at some legal books.

Well if he thinks you are cheating he must have a reason for this.He doesn't have the right to just toss your stuff out but he can ask you to leave.If you are cheating then he should demand that you go.Either way if you have kids both of you need to figure out a better way to handle this.Nobody is going to win here.

Here in Texas he can't. I think it depends on the state you live in. Find an attorney that gives free consultations or simply call a lawyers office and ask.
