Under federal law (the Fair Labor Standards Act), your employer has until your next regularly scheduled pay day to pay you. For instance, if you usually get paid every Friday, then they would have had until the Friday after your last week of working there to pay you.
However, not all businesses are subject to federal law - your best bet is to contact the US Department of Labor's Wage and Hour Division. You can find them online at www.dol.gov, or call 1-866-4US-WAGE toll free. They have investigators there who can ask the right questions to determine whether or not your employer is subject to federal law, and if you decide you want them to, they can even contact your employer and try to collect your check for you.
There may also be state laws that can help you in this situation - contact your state labor department or your Lieutenant Governor's office (numbers should be in the blue/government pages of your local phone book) to find out what they might be.

If it was just a waitress check, I'd probably just forget about it. It's not worth my time and effort. But otherwise, if it's a corporate restaurant, then find out the 1-800 number and call the payroll dept. If that gets you nowhere, then get a lawyer. You'll spend more on the lawyer than the check is worth, but if it's the principle of the issue you are going for, then it will be worth it.

Have you moved since you worked there? Most payroll checks are marked do not forward. Contact your last job and if no answer by phone, go to your nearest department of employment. You can tell them that you worked and did not get paid, they can bring your employment history up on their data base. It will show the last time that they reported wages for you. If it does not show your unpaid time, then you would have to go to the labor department to report unfair labor practices.

I would first try and get in touch with restaurant you worked for. If you do not get a satisfactory answer then you should get in touch with the "Better Business Burea" in your area and tell them your problem. Either they will follow up on your complaint, or they will advise you where to go. You can also go to "Small claims court" free, there is no charge.
