Until they've walked a mile in YOUR shoes, they don't have a clue what it's like, living like you've had to live these past 8 years. Do what you have to do! Yes they can divorce/seperate. In the nursing home there should be a social worker. That person can get you in touch with a professional who acts as a guardian/conservator. Because this man is on medicaid, he will probably have to utilize an ombudsman, who is someone who acts in the best interest of the elderly/disabled. They will see the divorce through with the husband and wife. It is easier to petition the courts for a dissolution of marriage when the one party is "unaware" of the situation, because they offer no contribution to the marriage. Usually, because of our fine system(haha), medicaid will not allow the spouse to have any substantial money or property, and there for divorce is a big option for a lot of elderly people who don't want to live in poverty. It can be done, and usually it can be an expidited process because of the situation ( around 90 days). Good Luck!!!!

Yes she can do this, it's done everyday in America. My father in law did this when his wife went to the nursing home with Alzhiemers.
Nothing wrong with doing this either. I mean the person's mind is pretty much gone. But in doing this my father-in-law was able to transfer all his assets to his only child (my wife), since he had nursing home longterm care insurance for his wife.
Father in law didn't live more than a year after he did this, but the mother-in-law is still alive and probably will be more many years. But like i said her mind is totally gone. She doesn't even know my wife her only child.

yes, seeing his condition she may have to go through a lot of legalities especially if there are children and other family members but with him being ill the court want see that as a fit reason for divorce or separation

yes she can due to medical reasons. But the marriage vows say in sickness and in health ". I guess they did not take their vows very seriously.
