I have just purchased an apartment in western sydney. I've done various inspections but none at night. Last night i went over to show my folks the place i'd bought when i heard the whole roof vibrating. It is caused by an exhaust fan on my roof from the chinese restaurant down stairs which only operates at night.
I'm afraid i'll have trouble keeping tennants with this noise... does anyone out there know how to handle this problem legally in australia??? I want to know as much as i can before i approach the body corporate and the owner of the restaurant. Any help would be appreciated.

PS. the fan and ducting are installed in a sub standard way where the duct is sitting directly on the roof tiles and the fan has someserious shaking going on.

EPA is the answer......

no matter if it is littering, smoke or noise polution.... they 'll investigate..... every hazardous situation......

open your phone catalog ....they must be somewhere in the front pages....

You have a few options, you can go straight to the police and make a complaint of excessive noise which the police are oblidged to investigate, unless they believe the complaint is frivolous. Your local government/ council should have legislation or a consolidated act which explains the process you need to go through, so the council is another good place to submit a complaint for bpth excess noise disturbance and building code violation (if applicable), like the liquor licensing act has legislation for excess noise.If this fails perhaps a visit to the office of fair trading may help.

Maybe you should ask the Council first how loud the noise can be, because the restaurant may not be doing anything wrong.
& even if it turns out they are at fault
make sure you are very nice to them & when you ask them to fix the fan up do it in a very sensible manner so you wont turn it into a dispute

Anonymously call the health inspector and the building inspectors. Either of them can report to the restaurant owner that the exhaust fan is substandard and in need of repair

have the charges in contact in sound proofing the section, greater advantageous yet replace the fan maximum are screwed up and out of stability if there is vibration, get it dealt with, c if that's placed on their section wall and not the place it reasons issues, we handle 3 hundred a great number of crap on precise of universities here and all that stuff is undertaking to alternative no remember if that's noisy or out of date or faulty in application that's known stuff ti hire a contractor to handle:piece of cake

Check the legal statutes regarding proper installation of accessories such as fans like this. It should be mounted & operated in such a way that it doesn't interfere with the sleep of your tenents & overall operation of your building.

ask them if they can do something about the fan and if they dont, call EPA
