Of course they are. In the U.S. you can purchase lots of things considered "paraphernalia" because in theory they have legitimate legal uses. You could use a hookah to smoke regular tobacco, even if most people won't, so it's legal. It's the same reason wrapping papers or pipes are legal as well.

Yes, you can get them at any local head shop. Some cities even have hookah bars. If Amarillo, TX has a hookah bar, I'm pretty sure they are legal everywhere in the US.

They are legal as long as you don't put anything illegal into them. (ie. Rezin from marijuana will make anything illegal. ) Pipes are legal, but when used to smoke pot, then become illegal.
