I received a notice of eviction if I don't pay my January rent and the Security deposit by Monday. Is it legal to just give a 3 day notice to pay? I owe $1200 total, $450 security deposit that bounced and $750 for January rent that was due on the 1st.

I am a landlord of 12 yrs. If your rent is due on the first, then on the 2nd he can give you a 7 day notice. That is, you have 7 days to pay or leave. If after that 7 days, he can file in court to evict you. Some states it is a 3 day notice to 'PAY OR QUIT' In other words pay the late rent in three days or move.
I do not have a grace period as some landlords do. You knew when you signed the lease it was due by the 1st. You should be adult enough to plan ahead to make sure its paid by then. Otherwise you suffer the consequences. My rules are that it must be postmarked no later than the 1st. I give it until the 3rd to reach me. Then you get hit with my $50.00 late fee and a 7 day notice. If you pay me and the late fee with in that 7 days, I dont file in court. If you dont, you will be going to court and will be evicted. As most landlords will tell you, this is a business and we will not get involved in your personal problems as to why you cant pay your rent on time.

It depends on your state and local laws. Depending on where you are it may very well be legal, but usually they also add on the court costs of having to process the eviction papers as well. Good luck, I hope you are able to straighten this out and not have to move.

in most states eviction proceeding can start on the thirteenth day of being late.
