The way someone explained it to me was that you would simply be accepting material that is available for free. and that distributing it is illegal as one of you said but your simply taking what is given to you. Anyways i wasnt convinced by this and i will stay on the safe side. Thanks for the help!

That depends where you live. In Canada, their courts have ruled that you can legally download, but you cannot legally upload. In the US, both are illegal if you do not have the permission of the copyright owner.

No. Actually, a P2P network, by definition, does not have a central server and 'uploading' and 'downloading' do not exist. Any sharing of copyrighted files is illegal. It doesn't matter which side of the sharing you are on. The only exception is if the copyright owner is the one making the files available. If you own the copyright, you can give the files away all you want.

I don't think that would be the case - but I would not recommend uploading copyrighted material in any kind of way - it would still be classed as unauthorized distribution. Just spend your 99cents to be on the safe side.

No it's not true, has nothing to do with uploading or downloading, it has everything to do with copywrite. If I as an indy band put my music out there with no copywrite or specifically disclaim it can be shared then you can upload or download all day long P2P

Some material is considered public domain, but yea.. most isn't and if you really want to split hairs, it's illegal to share or copy in any fashion, that material. Documents, music or otherwise, when you upload YOUR SHARING.

Both are illegal, just having them is illegal. If you didn't pay for it, its called stealing. When you allow other to steal, its called abiding to a crime.
