The state is CT. I am 26, the driver is over the legal age for drinking also. In fact no one in the car would be under age.

Ok I know about the open container law, but what if you put the beer in like a mcdonalds cup or a coffee mug? How would they know?

Only if you are in your drive way. Most States anymore, you cannot have an open container in a vehicle even if the vehicle is turned off. They still consider that an offence because you are in a vehicle and you can always operate it later after drinking.

Yes, under the "Open Container Laws" any open container inside the car is a chargeable offense.

In almost all the states except for a few it is not legal. I was a resident of connecticut and can tell you that it is not legal. Both you and the driver will get ticketed and car can be impounded. Falls under the open container law. Also the driver is legally responsible for his passengers That is considered a DUI there.

Yes it is illegal! As for putting it in another container, they'd know due to the odor and your behavior. Also, putting it in another container does NOT get around the open container law.

There is an open container law in my state. not sure about others.

edit: I have been pulled over and they have asked to smell what i am drinking.

Not legal. Not even legal to have an unopened alcohol drink in the car. Has to be in the trunk

actually, i've seen people arrested in their driveway for drinking while sitting on their motorcycle without it being on, so either you're wrong or the cop was. who knows though.

while they can get you with open container,most cops wouldn't. there are better places to get legal advice than yahoo.
