I’d have to say that the Penguin is tougher. He is more ruthless, especially in the realm of pure crime, organized crime. Turtle was a one-shtick wonder, even the fact that he was fighting the Flash doesn’t qualify him as such a tough super villain. (I rate most of Flash’s Rogues as about on a par with the Riddler, a loser who is compelled to leave clues for Batman because he WANTS TO BE defeated.)
Same holds for the Turtle. With him, it was just a challenge of wits. Could he, the world’s slowest villain, beat the Fastest Man Alive? It was his ego, the old tortoise vs hare business. When they brought him back (only once, that I am aware of) Flash quickly (NPI) collared him.
In contrast, Penguin has returned to challenge Batman again and again. Even with his inherent super powers, Flash respects Batman, and so there is no question of whether they are fighting comparable opponents. Penguin is more experienced, takes his crime more serious. He is more ruthless. No silly tricks and no settling for mere humiliation of his enemy. The Penguin would drill through the Turtle’s shell with his umbrella, and stab him to death.

I don't know if you're asking that, but I'd say so 'cause he'd like go all dancing (like happy feet) and dance on the shell, making the turtle have a headache. Cause penguins are too COOL.
