she put down $5,000 before we were married and now wants it back, however, after I filed for divorce (date of seperation) I was ordered out of the house and forced to pay mortgage and utilities for 6 months, well over her $5,000. All I'm asking for is half the money. Yes she did put it down before the marriage, but I paid everything after the date of seperation. Will I get my half of the money?

You're going to have to fight this one out through your lawyers. Because the house was aquired before you were married, it is not a marital asset.

I was in the same boat, and we got a prenup that spells eveything out...

If you two don't wish to be giving it all up to an (or two) attorneys, you had better come to some agreement. If you use a mediating attorney, (look in the yellow pages under attorneys - divorce -- mediating) who represents you both, and who just fills out the papers and files them, the cost total is somewhere between $75-300. If you each get an attorney, and you have at it, the only ones who win are the two attorneys --- at about $6000 each---way over your $10,000 buckos. So, each of you need to decide what is far, and have a divorce that is non-adversarial.... otherwise, kiss your cashola adios.

Normally, you and your ex will split the equity (profit from sale) from your house, regardless of who put money down, or who paid the bills until the divorce was finalized.

It depends on the laws in your state, but you should. It's considered community property and should be split 50/50
