Would it be possible for a landlord to take out the late fee from the security deposit we gave? At the time we moved in, we gave a $500 security deposit. There is nothing to fix in this apartment whenever we move, except the basic carpet clean and white wall paint which the landlord can see.

Many of you missed on my last question: the landlord insists she pick up the rent every month because many people have moved out before without a notice. She always walks in and checks if we are moving. **Very paranoid**

Fine, no answers... I really do want to move since I hate this landlord anyway and the apartment also. Maybe that is why down deep psychologically people don't want to try to pay the rent on time...

No she won't be willing to do that. It's that the deposit gets eaten up over time like that and she needs it just in case, that's what it's for.

But! If you leave the apartment really nice just like before you moved in, with the exception of painting. You are legally entitled to 100% of your deposit back So there is $500 you can get. Shampoo the carpet, degrease the stove and wash the windows. It's pretty easy for a whopping $500.

Technically the security deposit is to be held in a separate account that neither you nor the landlord are to touch until you terminate your lease. So, no the late fee can't be taken from your security deposit.
