Yes. If you had a divorce, why would there be no legal documents? Most states have laws on their books that parents of children must pay child support. The obligation and the actual payment are two different issues. If you can prove paternity, you can get back support. That should be the rule in most states.

Call the State Bar Association and ask if they have any free lawyer referral services or call an attorney of your choosing. Most lawyers will answer your questions on the phone.

Why do people call it child support when all the money goes to the mother to spend as she pleases?

To answer your sorry question, yes the laws say the State can collect tens of thousands based from the birth of the child. This creates a huge debt for all young men that will force them into a life of poverty and be known as a second class citizen called the deadbeat dad.

Ths will effect 60,000,000 Americans, who will be forced by the state to pay extortionate mommy support rates.

It's funny how people scream when their car insurance increases by just 5%, imigine if you had to pay $1600 every month plus medical care and child care too.

Then imagine how angry you woudl be if you saw yrou kids running around in rags and she askes for more money to buy the kids clothes.

So how much does the mother pay, nothing!

If there was not an order for CS in the Divorce, then the answer is no. You can file for support (I'm assuming paternity has been previously established) and the court can make it retroactive back to date you filed the petition asking for CS.

If your attorney and judge did not address CS as part of divorce and custody, then you got screwed....unless your the payor--in which case you caught a lucky break!

Without legal documentation, there is precious little you can do to obtain remuneration. After all, how can there be any back child support to begin with if there isn't any legal documentation awarding child support in the first place?

Can always ask. May not always be granted. If it goes to court the judge will make the decision based on the local guidelines.

i would imagine so. the child still belongs to the parents, together or not. people often go to court and tweak payments and things like that, after a divorce. go for it. i think in every state, it is against the law to not pay for your child. go after him/her.
