My son is 21+, born in the state of Hawaii. His biological father has never paid child support. Is it too late for me to file and get back/overdue support.

If you never had an agreement for his father to pay you child support, you can't get it now. You only pay support up to 18 years old. If you had an agreement for him to pay and he never paid, you are entitled to ALL of it.

Back child support never goes away. The person oweing it will never be forced to pay this money if the person who was supposed to receive it never pushes the issue.

There have been cases where mothers have gotten back child support owed to them long after the children were grown and had children of their own.

Filing does not have anything to do with it, or when you were ordered to pay child support. My ex and I were seperated for a year. When I was ordered to pay child support one year later, I had to furnish proof that I paid "child support" on my own during the seperation, or I would have had to pay back child support for the year we were seperated.

It does not go away. But, if you do not push the issue, he will never be forced to pay.

Seriously? You wait 21 years and NOW you want back support? Sounds like you just want a big fat check so you can go out and have some fun now that your son is an adult. I'd take a serious look at why you're doing this now.

depends if the father was ordered to pay child support then you will be able to get what is owed to you from the date of birth till the childs 18th bday or 21 if in school.

If you never brought the father to court for child support chances are you will not be able to collect.

you cannot get child support if you file after the child is no longer considered a minor in your state.
unless you have an open case, there is no order to collect on.

More important, does the bio dad owe you anything?

The laws were created to ensure the well being of children while they are growing up, you are looking at this as an investment that needs to be collected.

I doubt the father has $400,000 sitting around to pay you!

SORRY YOU ARE OUT OF LUCK THE TIME LIMIT HAS EXPIRED. THE COURTS WILL ONLY HONOR RETROACTIVE CHILD SUPPORT TO THE DAY YOU FILED IN COURT. THEY CAN ONLY ENFORCE PAYMENT FROM THE VERY FIRST DAY THAT YOU FILE FOR SUPPORT. THEY ARE NOT CONCERNED WITH ANY SUPPORT BEFORE THE INITIAL FILE DATE.

You need to talk about that with the government office. Why are you wait so long? 21 years you didn't taking care this problem. I hope you can get your money and it's not late. Good luck.

Child support is not a debt that is excused. So go get your money!
