I guesss due to the holiday my rent payment was received late. I reveied a very treatening letter that was laid out in a way that seams as if I was being sued ( It said IMT vs plaintiff & my name). It also stated that if I did not pay my rent I would need to move out with in 3 days. Not only did I feel I was being wronfully sued but I also felt as if I was being kicked out.
I don't bother anyone in the building, I'm not noisy, follow all the rules & have never been late with my rent and I don't feel that after a few DAYS late i should be receiving a letter like this. A friendly reminder is one thing, I can even understand a late fee but a treatening letter?
Are they allowed to do this to tenants?

While it is legal to give a "3 Day Notice to Pay or Quit", it would be unusual to receive one for the first instance of being late. Furthermore, your remedy is to simply pay the rent, or check to see if your check has cleared yet. While the legal language might be perceived as offensive or threatening, you have several options in CA, especially if your city has rent control.

The eviction process takes much longer than 3 days. That notice is only the first step, and if they have accepted your check, then they can not proceed with any eviction.

it was a warning. did the payment make it there afterall? call and make sure the payment was received. if it wasn't, then it was assumed you refused to pay. respond to the letter. it is possible that letter was just a standard pay or quit notice.

We legally have to post notices basically informing you that if you don't pay then we're taking back the apartment.

also, they can't give you anything less than 30 days. that 3 day limit is a scare tactic, and also illegal. >I think that CA (or was it just la county) just changed that 30 days to 60 days minium.
