My uncle who is 96 hired a caregiver through a service agency to care for his wife but kept her when his wife died. Somehow she got a hold on him. I think he was lonely. She started giving him Viagra and you can imagine what they are doing. Now he says she is his girlfriend. This has gone on 2 years now. She asks him for money all the time, brings her x around, and moves in and out when she feels like it.
He is old and does not see her for what she is, a leech. I would not be surprised if she did not get him to change his will. She is sticking around for some reason.

My uncle has one daughter and 5 grandkids and 2 great grandkids that live close. The daughter (my cousin) lives right behind him but has been threatened many times by this woman. She is African American and uses this as power. My uncle is quite WEALTHY.

My cousin has tried talking to agencies but they all say he is of consenting age. He lives in California.

She can not be fired as she quit the agency and he employed her directly.

My cousins hands are tied as she tried many agencies for help. They all send her away like she is meddling. They call him and he says she is crazy and lying. It is terrible as he does not see this woman is a CON.

Yes, your uncle is of consenting age, so there's no law against him having a sexual relationship. The problem comes in when it's his caregiver. If this person is both providing care for your uncle and sexually active with him, that is a conflict of interest, and against the law. Each county in California has a Community Care Licensing Agency, that is responsible for overseeing elder care licensing. Please contact that agency and describe the situation. Provide as much information as possible for community care licensing to follow up with possible legal and license issues. If you are unable to determine the Community Care Licensing Agency, then please contact the California Ombudsman, who should be able to take the matter to the appropriate agency. Please continue to follow the trail to whoever oversees the care giving, and in that way help insure the safety and integrity of our care giving system. Thank you for your concern.

The caregiver's agency should be notified!!! All agencies have strict rules re: boundaries as well as being hired by a family individually. This also sounds like and elder abuse case (in CA, the protective agency for adults is called APS)

I would say definately file a complaint with the agency, and also have her replaced if at all possible. She has obviously crossed some boundries. She was not hired to have sex with your uncle, she was hired to take care of him. He is a client not a john.

He may be of consenting age, but is he mentally competent? If your cousin can prove to the courts that he is not competent, she may become his legal guardian. And there are laws against threatening/harrassing an individual (in this case the caregiver threatening your cousin). She needs to seek legal counsel.

You must fire her!
Report it to the agency and make sure you document everything! In addition, she should be charged with elder abuse by your uncle's daughter, and you should file a restraining order.
