I don't know if it's a law for the country but I know that in Ohio it is mandatory to provide benefits to any person who works over 30 hours per week on average in a year.
I really think that is pretty standard in every state but I am not absolutely certain.

NO - but if you are going to give benefits to any single employee, and not to another, you better have bona fide business reasons for doing so. That is, you want to make sure that you can divide the "Benefits" group from the "No benefits" group based on salary, or department, or hours, or something, so that you protect yourself from any allegation that you made your decision between them based on age, gender, race, nationality, disability, gender, religion, pregnancy, or any other protected class.
